3. PRODUCTS & AUTHENTICITY CLAUSE (HANDCRAFTED NATURE)

3.1 All products sold by Chikan Kahani are handcrafted using traditional Chikankari techniques.

3.2 Artisan Variation Disclaimer:

  • Each product is individually hand-stitched by skilled artisans.

  • Minor variations may occur in:

    • Thread tension

    • Motif placement

    • Embroidery density

    • Color tone (due to dyeing processes)

3.3 These variations:

  • Are inherent to handmade craftsmanship

  • Serve as proof of authenticity

  • Do NOT qualify as defects

3.4 Customers acknowledge that:

  • No two products will be identical

  • Slight irregularities are a hallmark of genuine Chikankari work

 

4. PRICING & PAYMENTS

4.1 All prices are listed in Indian Rupees (INR ₹) and are inclusive/exclusive of taxes as indicated.

4.2 Payments must be made through authorized payment gateways.

4.3 Right to Refuse Service:
Chikan Kahani reserves the unconditional right to:

  • Refuse or cancel any order at its sole discretion

  • Limit quantities purchased per user

4.4 Reasons for refusal may include:

  • Pricing errors

  • Suspected fraudulent transactions

  • Product unavailability

 

5. ORDER ACCEPTANCE & CONTRACT FORMATION

5.1 Placing an order constitutes an offer to purchase, not acceptance.

5.2 Contract Formation Clause:

  • The order is deemed accepted only upon dispatch/shipping confirmation email

  • Until then, Chikan Kahani reserves the right to cancel the order

5.3 If an order is cancelled:

  • Full refund will be processed to the original payment method

 

6. SHIPPING, DELIVERY & RISK OF LOSS

6.1 Delivery timelines are indicative and not guaranteed.

6.2 Orders are shipped via third-party logistics partners.

6.3 Risk of Loss Clause:

  • Risk transfers to the customer upon handover to the carrier

  • Ownership transfers upon full payment

6.4 While Chikan Kahani:

  • Will assist in tracking shipments

  • Will support dispute resolution

It shall not be liable for:

  • Delays caused by courier partners

  • Losses after dispatch (subject to reasonable assistance)

 

7. RETURNS, REFUNDS & INSPECTION POLICY

7.1 Inspection Window:

  • Customers must report issues within 48 hours of delivery

7.2 Returns are accepted only if:

  • Product is damaged, defective, or incorrect

7.3 Return Conditions:

  • Product must be unused

  • Must be in original packaging with tags intact

7.4 Final Inspection Authority:

  • Chikan Kahani reserves the exclusive right to determine:

    • Whether the product is unused

    • Whether it qualifies for return/refund

  • This decision shall be final and binding

7.5 Non-Returnable Items:

  • Customized products

  • Made-to-order Chikankari pieces

  • Products damaged due to misuse

7.6 Refunds:

  • Processed post inspection

  • Credited to original payment method within reasonable time

 

8. INTELLECTUAL PROPERTY RIGHTS

8.1 All content on the website is owned by Chikan Kahani, including:

  • Logos

  • Images

  • Product designs

  • Website content

8.2 Proprietary Design Protection:

  • Chikankari patterns and design layouts developed by Chikan Kahani are proprietary assets

8.3 Unauthorized use, reproduction, or distribution is strictly prohibited and may lead to legal action.

 

9. USER CONDUCT

9.1 Users agree not to:

  • Engage in fraudulent activities

  • Attempt unauthorized access to systems

  • Use the platform for unlawful purposes

9.2 Violation may result in:

  • Account suspension

  • Legal action

 

10. LIMITATION OF LIABILITY

10.1 Chikan Kahani shall not be liable for:

  • Indirect or consequential damages

  • Loss of profits or business

  • Delays beyond reasonable control

10.2 Liability, if any, shall be limited to the value of the product purchased.

12. GOVERNING LAW & JURISDICTION
